Mike Liprttrif for Congress (hereinafter “We,” “Us,” “Our”) is offering a mobile messaging program (the “Program”), which you agree to use and participate in subject to these Mobile Messaging Terms and Conditions and Privacy Policy (the “Terms and Mobile Messaging Privacy Policy”). By opting into or participating in any of our Programs, you accept and agree to these Terms and Mobile Messaging Privacy Policy, including, without limitation, your agreement to resolve any disputes with us through binding, individual-only arbitration, as detailed in the “Dispute Resolution” section below.

Modification of Terms and Mobile Messaging Privacy Policy

We reserve the right to revise these Terms and Mobile Messaging Privacy Policy from time to time. Revisions will be effective upon the effective date indicated at the top of this document. Any updates will be posted on mikeliprttriforcongress.com. Your continued participation in the Program after updates have been posted constitutes your acceptance of those revisions.

User Opt-In

The Program allows users to receive mobile messages by affirmatively opting in. By opting in, you authorize Mike Liprttrif for Congress to deliver campaign-related calls and/or text messages using an automatic telephone dialing system (or “autodialer”) or an artificial or prerecorded voice.

Duty to Notify and Indemnify

If you intend to stop using the mobile telephone number used to subscribe to the Program (including selling or transferring the number), you agree to complete the User Opt-Out process first.
INDEMNITY: YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD US HARMLESS FROM ANY CLAIM OR LIABILITY (INCLUDING TCPA CLAIMS) RESULTING FROM YOUR FAILURE TO NOTIFY US OF A CHANGE IN YOUR CONTACT INFORMATION.

Program Description

Users can expect to receive campaign-related messages from Mike Liprttrif for Congress. Messages may include fundraising requests, volunteer opportunities, campaign news, online events, and TV appearances.

Cost and Frequency
​
Message and data rates may apply. The Program involves single and recurring mobile messages. Messages will occur as frequently as the campaign necessitates.

Mobile Messaging Privacy Policy

We respect your privacy. This policy applies strictly to the Program and describes how we handle personal information.

Use of Information: To provide the Program, deliver campaign updates, improve service, and ensure security.

Sharing Information: WE DO NOT SELL, RENT, LOAN, TRADE, LEASE OR OTHERWISE TRANSFER FOR PROFIT ANY PHONE NUMBERS COLLECTED THROUGH THE PROGRAM TO ANY THIRD PARTY. We may share information with trusted service providers (like text messaging platforms) only as necessary to facilitate the Program.
Dispute Resolution

Any dispute or claim arising out of these Terms or the Program will be determined by binding, individual-only arbitration in New York before one arbitrator, in accordance with the Commercial Arbitration Rules of the American Arbitration Association (AAA).

The parties waive any right to a jury trial.

The parties agree to arbitrate solely on an individual basis; class arbitrations are not permitted.

This provision survives the termination of your participation in the Program.

Miscellaneous
​
You represent that you have the authority to agree to these Terms. If any provision is found unenforceable, it will be limited to the minimum extent necessary so that the remainder of the agreement remains in effect.
